TERMS OF USE
The SafeHouseBox is offered to you by LowTech, LLC (“LowTech”) conditioned upon your acceptance without modification of the terms, conditions, and notices contained herein, including the binding arbitration provision contained in the “Dispute Resolution” section. By purchasing SafeHouseBox or any other of LowTech’s products, you agree to terms and conditions of this TERMS OF USE agreement. LowTech offers its products, including SafeHouseBox, with the terms, conditions, and notices as follows:
Use Limitations
This product has been designed for the specific use and applications described in instructional materials accompanying this product. Any use contrary to the specified use is considered unauthorized. This product may not be used for unlawful purposes, and any unauthorized use, whether lawful or unlawful, is expressly prohibited under the terms and conditions of its use. Additionally, you may not copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell, any information, relating to LowTech’s products, including SafeHouseBox and other products.
Assumption of Risk and Limitation of Liability
By purchasing, using, or allowing the use of LowTech’s products, you expressly and voluntarily assume any risk of personal injury sustained while using LowTech’s products. In no event shall LowTech be liable for any direct, indirect, punitive, incidental, special consequential damages, to property or life, whatsoever arising out of or connected with the use or misuse of our products. Additionally, you agree to indemnify, defend, and hold LowTech harmless from any third-party claims arising from any such use or misuse of LowTech’s products.
Limited Warranty
LowTech warrants that the SafeHouseBox under normal use and service will be free from mechanical defects in materials and workmanship for a period of ninety (90) days from the date of purchase. No other guarantees, express or implied, are given to the product efficiency, product performance and production or its improvement. If there is a warranty claim, you must return the product to us at your own cost. If the claim is valid and the defect is covered by our warranty, we will repair or replace the product and return it to you at our own cost.
Limitation Of Liability
In no event shall LowTech be liable for any direct, indirect, punitive, incidental, special consequential damages, to property or life, whatsoever arising out of or connected with the use or misuse of LowTech’s products. Additionally, you agree to indemnify and hold LowTech harmless from any third party claims arising from any use or misuse of our products.
Entire Obligation
This TERMS OF USE agreement states the entire obligation of LowTech with respect to the products it sells and/or offers for sale.
Severability
If any part of this TERMS OF USE agreement is determined to be invalid, void, unenforceable or illegal, including, but not limited to the warranty disclaimers and liability disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall remain in full force and effects.
Dispute Resolution
You agree that any dispute or claim relating in any way to your use of LowTech’s products will be resolved by binding arbitration, rather than in court. The Federal Arbitration Act and federal arbitration law apply to this agreement. Use of this product is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph.
Modification of Terms and Conditions
LowTech reserves the right to change the terms, conditions, and notices under which LowTech products are offered.
